By using our products and services you notify that you accept our Terms of Use.
Please read these Terms of Use carefully before accessing or using Midway Ai products and software services, which are provided by Midway (“Company”).
Acceptance By accessing or using the Midway Ai products, you agree to be bound by all of the Terms, inclusive of any future modifications or additions. If you do not agree to all of the Terms, then you may not access or use the products.
Age Restriction You must be 18 years of age or older to access or use the Midway Ai products. We do not allow/promote users to use our NSFW image Ai to produce illegal imagery like Sexual Minor /Dangerous/Hate/Misuse imagery,Individuals attempting to train/trick the Ai into producing such content will be flagged by our systems and will be reported and removed from our platform permanently. By accessing or using the Products, you represent and warrant that you are 18 years of age or older and that you agree to abide by all of the terms and conditions of these Terms.
Content You understand that Midway Ai products generate images and texts which may contain content deemed as Not Safe For Work (NSFW) or any Non-PC content. You agree to be responsible for any such content and understand that Midway is not responsible for any content created or accessed through its Services.
Intellectual Property Rights and Licenses All logos, software and services used in connection with the Midway Ai products are the exclusive property of Midway and/or its licensors and are subject to copyright and other intellectual property rights. No part of this content may be copied, duplicated, modified, republished, uploaded, posted, transmitted, or distributed in any way for commercial use without obtaining prior written consent from Midway. Generated imagery and Outputs can be owned/shared for commercial use in the event that you have a current paid plan with Midway.
You may not use Midway Ai products for any illegal purpose, or in violation of any applicable domestic or international laws, including copyright and other intellectual property rights. You are solely responsible for your conduct while using the products, and you will indemnify Midway and its affiliates against any harm, claims or damages resulting from your use of the products, or violation of any applicable law or the Terms.
5.No Warranties Midway makes no warranties or representations about the accuracy or completeness of any content generated or made available through its services and products. The company disclaims all warranties, either express or implied, statutory or otherwise, regarding the products, including without limitation any warranties of merchantability, fitness for a particular purpose, title and non-infringement.
Limitation of Liability Midway shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages, losses, costs, or expenses resulting from the use of the products, even if Midway has been advised of the possibility of such damages.
Termination You may terminate your use of the products at any time, in accordance with the Terms of Use. Midway may also terminate or suspend your access to the products, with or without notice and in its sole discretion, should it find any breach of these Terms.
Violations and Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of [America] without giving effect to any principles of conflicts of law. You agree to submit to the personal jurisdiction of the state and federal courts located within [the United States & international Laws] and waive any jurisdictional, venue, or inconvenient forum objections to such courts.
In the case of any violation of these Terms, Midway reserves the right to seek all remedies available by law and in equity for such violations.
